Post Canadian LLC?

Hi Moe,

I’d be interested to know if you have a company behind Keywordsblogger and/or Nichesherpa? If so what type is it?

US people have the option to use LLCs because they are less a pain in the @ than Incorporation and still offer the low liability protection.

My question is, how do you do this as a Canadian?

Hi Simon – interesting question. Do you want to register as a company for liability purposes?

I haven’t registered as a company, and just operate as a sole proprietorship. I suppose at some point in the future I’ll have to consider incorporating, but for now my accountant says being a sole proprietor is fine.

For liability purposes -yes.

What if you get sued for I don’t know…. Let’s say you recommend a middle aged overweight guy to use vitamin D3 to help reduce fat and he ends up getting lupus because he is intolerant to it and decides to sue you? (I really don’t know what I’m talking about but you get the point 🙂

I guess my question is, do you speak with a lawyer before you put anything online?

How are internet marketers protected by law? And I guess it must be different for affiliates than for product owners…

Is there a default agreement between Internet users and website owners that everything is solely at the user’s own risks?

I could be wrong on this, Simon, but my understanding is that having a “Disclaimer” statement on your website should cover this.

On all of my health websites I have one page that says, in effect, “I’m not a doctor…content on this site is provided for information purposes only…always consult a doctor before undergoing a treatment…etc”. In fact, on one of my sites I have the disclaimer prominently on the homepage (Google’s Adwords program is really cracking down on sites, and is now expecting them to have their disclaimer statement front-and-center).

Hi Moe,

I was wondering if you still operate as a sole proprietorship? I’ve heard business structure talk on other internet marketing podcasts and assumed that’s what you’re supposed to do. Also, forming a company (at least in the US) helps to reduce your tax liability or so I’ve heard.

Hi Tapiwa – I still operate as a sole proprietorship. My account said the tax benefits aren’t worth switching to a LLC (and I’m not worried about personal liability).
